Terms & Conditions

The agreement between you and us when you book a Hazy campervan. Please read these in full before completing your booking - by booking, you agree to abide by these terms.

01 - Introduction

Welcome to Hazy Campers! These Terms and Conditions govern your rental of our campervans in New Zealand. By completing your booking and signing the Rental Agreement at pick-up, you agree to abide by these terms. Words like "we", "us" and "Hazy" refer to Fortescue Campers Limited trading as Hazy Campers. "You" or "the Hirer" refers to the person named on the Rental Agreement and any authorised additional drivers.

02 - Eligibility & Drivers

To rent a Hazy campervan, you and every authorised driver must:

  • Be at least 21 years old and hold a current full driver's licence.
  • Hold a licence in English or carry a valid International Driving Permit.
  • Not be the holder of a learner, restricted, provisional or probationary licence.
  • Not have been convicted of a serious driving offence or had a licence cancelled, suspended or disqualified in the previous three years.
  • Not have been refused motor vehicle insurance, or had insurance cancelled, in the previous three years.

All drivers must present their physical licence at pick-up. Only persons named in and signing the Rental Agreement are authorised to drive the vehicle. You are responsible for the conduct of every authorised driver as if it were your own.

03 - Pick-up & Vehicle Condition Report

At pick-up we'll walk through the campervan with you and complete a Vehicle Condition Report together — noting fuel level, odometer, and any existing wear, dents or scratches. You will be asked to sign it.

Any damage that is not recorded on the Vehicle Condition Report at pick-up will be considered to have occurred during your rental, and you will be responsible for it under section 12 (Insurance & damage assessment).

If the booked vehicle is unavailable, we may substitute an equivalent or better vehicle at no additional charge. You may decline the substitution at pick-up; if you do, we'll refund any unused portion of your booking.

04 - Your Responsibilities

As the Hirer, you agree to:

  • Comply with all New Zealand road rules at all times.
  • Keep the vehicle locked whenever it is unattended, and keep the keys in your possession.
  • Take reasonable care of the vehicle and drive it in a safe and legal manner.
  • Monitor warning lights, dashboard alerts and fluid levels (oil, coolant, water) and notify us immediately if any concern arises.
  • Empty the toilet and grey-water tanks before returning the vehicle.
  • Refill the fresh-water tank and return the vehicle with the same fuel level at which it was collected.
  • Return the vehicle clean — dishes washed and put away, surfaces wiped, sand and dirt swept out.
  • Return the vehicle to the agreed Return Location by the agreed Return Time.
  • Not smoke or vape inside the campervan or within 5 metres of it. A $300 cleaning fee applies.
  • Not bring pets inside the vehicle (service animals excepted). A $300 cleaning fee applies.

05 - Prohibited Uses

You must not, and must ensure no authorised driver does, use the vehicle:

  • While under the influence of alcohol, drugs, or any substance that impairs driving ability — or while exceeding the legal limit set by New Zealand law.
  • In a dangerous, wilful or reckless manner, or while it is in an unsafe or un-roadworthy condition.
  • Off-road — including beaches, sand, riverbeds, fire trails, tracks, paddocks, fields, ski-field access roads, or any unsealed surface not maintained as a public road.
  • To cross creeks, rivers, flooded areas or any submerged surface, including salt water.
  • For any illegal purpose, or to carry or be used in connection with illicit drugs.
  • To carry passengers for hire, reward, or any other commercial gain.
  • To carry any flammable, explosive or corrosive materials, or unauthorised generators or fuel.
  • To push, tow or recover any other vehicle, trailer, boat or object.
  • For racing, pace-making, reliability or speed trials, or hill-climbing.
  • To carry more passengers, or a greater load, than the vehicle is designed and certified for.
  • To sub-let, sub-rent, sell, or otherwise dispose of, or to allow any person not listed as an authorised driver to drive it.
  • With any modification or alteration that has not been approved by us in writing.

06 - Substantial Breach

Important: if you commit a Substantial Breach, your insurance cover is void — regardless of which insurance option you selected at booking. You will be personally liable for the full cost of loss, damage, repair, recovery and any third-party claim.

A Substantial Breach includes (without limitation) any of the following:

  • Operating the vehicle while impaired by alcohol or drugs, or while disqualified, unlicensed, or otherwise not legally permitted to drive in New Zealand.
  • Allowing an unauthorised driver to operate the vehicle.
  • Off-road use, water submersion, or driving on a beach or river crossing.
  • Using the wrong fuel type, or putting fuel or any contaminant into the water tank.
  • Driving despite a warning light being illuminated, or a coolant gauge in the red — and failing to stop and contact us.
  • Damage caused by falling asleep at the wheel, sitting or standing on the bonnet or roof, or driving with the handbrake engaged.
  • Leaving the vehicle unlocked, or leaving the keys in or on the vehicle, resulting in loss or damage.
  • Any wilful, reckless or grossly negligent act or omission by you or an authorised driver.
  • Reckless or wilful misconduct, including damage caused by sitting or standing on the vehicle's bodywork.

07 - Our Responsibilities

We will provide a vehicle that is mechanically sound, road-legal and compliant with New Zealand regulations at the start of your rental.

7.1 Breakdown

If the vehicle breaks down due to mechanical failure not caused by your negligence or misuse, we will provide 24/7 roadside assistance, arrange towing where required, and offer a replacement vehicle if the issue cannot be resolved within a reasonable timeframe (subject to availability).

7.2 Accident assistance

In the event of an accident — regardless of fault — we will assist with police reports, insurance contact, towing if needed, and (subject to availability and the circumstances) offer a replacement vehicle.

7.3 Refunds for unavailable days

If the vehicle is undriveable due to mechanical failure or an accident not caused by you, we'll refund the daily rate for the days the vehicle is out of service. No refund applies if the issue arises from your negligence, misuse or breach of these terms.

08 - Maintenance & Repairs

8.1 Routine checks

You are responsible for keeping fluid levels (oil, coolant, washer fluid) topped up, monitoring tyre condition and pressure, and checking lights, indicators and brake response throughout the rental.

8.2 Reporting issues

You must report any mechanical or operational issue, abnormality or warning light to us as soon as practicable. Failure to report a fault promptly may make you liable for damage that could otherwise have been avoided.

8.3 Repairs & tyre/windscreen replacement

You must not perform, authorise or pay for any repair, modification or alteration to the vehicle — including tyre or windscreen replacement — without our prior written approval. We will not refund unauthorised work. For approved repairs we will direct you to an authorised partner.

8.4 Fuel policy

Return the vehicle with the same fuel level at which you collected it. Shortfalls will be charged at $4.00 NZD per litre (which includes a service component). Use only the fuel type specified by the manufacturer — wrong-fuel damage is your liability under section 6 (Substantial breach).

09 - Accidents Involving the Vehicle

9.1 At the scene

Check for injuries and call emergency services on 111 if required. If safe to do so, move the vehicle out of traffic. Do not admit fault or sign any third-party statement of liability.

9.2 Notify authorities & us

Report the incident to NZ Police where there are injuries, fatalities or significant property damage. Contact Hazy as soon as possible — +64 27 822 0049 or hello@hazycampers.co.nz — with the time, date, location, contact details for all parties, and any witness details.

9.3 Documentation

Complete the Hazy accident-report form (we'll send it to you), and take photographs of the scene, damage to all vehicles, road conditions and signage. Cooperate with us and our insurers in any investigation.

9.4 Liability

You may be liable for repair costs, loss-of-use charges and any other expenses arising from an accident where you are at fault, subject to your insurance option (section 12) and section 6 (Substantial breach).

10 - Fines, Tolls & Infringements

You are responsible for, and must pay, all fines, infringements, tolls, parking charges, clamping, towing and release fees, and any associated penalties or interest arising during your rental — including any received by us after the rental has ended.

By signing the Rental Agreement, you authorise us to:

  • Pass your details (including name, address and licence number) to the relevant enforcement authority so the infringement can be reissued directly to you.
  • Pay any fine or infringement on your behalf and recover the full amount from you, together with an administration fee of $50 NZD per infringement.
  • Charge your nominated card for any amount payable under this section, with prior notice by email.

You must promptly assist any enforcement authority that contacts you, and forward to us any summons, complaint or notice relating to your rental of the vehicle.

11 - Bonds & Deposits

11.1 Refund conditions

If you have paid a security bond, it will be refunded in full provided the vehicle is returned on time, to the agreed location, in the same condition (fair wear and tear excepted), and no third-party claim is pending.

11.2 Deductions

By signing the Rental Agreement, you authorise us to deduct from your bond any amount necessary to cover repairs, replacements, cleaning fees, fines, third-party claims or other charges arising under this Agreement.

11.3 Retention

We may retain all or part of your bond for a reasonable period after the rental ends to resolve any damage, claim or charge. Where a third-party claim is still being processed, the bond may be held until that claim is resolved.

12 - Insurance & Damage Assessment

12.1 Insurance options

Every rental includes our Risk Taker base cover at no daily charge ($3,000 bond, $5,000 maximum payout for total loss). We strongly recommend upgrading to Standard or Premium cover at $35/day (maximum $1,500), which removes the bond requirement, covers the front windscreen and reduces your total-loss liability to $0. The full list of insurance exclusions is set out in section 13 below; the Substantial Breach provisions in section 6 apply on top of these exclusions.

12.2 Travel insurance

Hazy strongly recommends you obtain your own travel insurance to cover unforeseen circumstances such as medical emergencies, trip interruption, personal injury or loss of personal property. Our vehicle insurance does not cover any of these.

12.3 Damage assessment

On return we'll inspect the vehicle against the Vehicle Condition Report completed at pick-up (section 3). If new damage is found, you'll receive a written assessment and invoice detailing the parts, labour and any third-party costs to be deducted from your bond or charged to your card.

12.4 Personal property

We are not responsible for any personal property left in or on the vehicle, including before, during or after the rental period. Please remove valuables on return and at every stop. We recommend your travel insurance covers personal items.

13 - Insurance Exclusions

The following situations, damages, expenses and costs are not covered by any Hazy insurance option (Risk Taker, Standard or Premium). These exclusions apply in addition to, and alongside, the Substantial Breach provisions in section 6.

13.1 Driver-related exclusions

  • Impaired driving — damage occurring when the driver is under the influence of alcohol or any substance that impairs their driving ability.
  • Unauthorised drivers — damage where the vehicle is operated by anyone not explicitly listed in the Rental Agreement.
  • Unlicensed driving — damage where the driver is disqualified, unlicensed, or not legally permitted to drive in New Zealand.
  • Driving offences — any costs arising from an incident where the driver is convicted of a driving offence related to that event.

13.2 Vehicle condition & usage exclusions

  • Unsafe vehicle condition — damage caused or contributed to by the vehicle being in an unsafe or un-roadworthy condition that developed during the rental period, where you or the driver were (or should have been) aware of it.
  • Off-road use — including fire trails, beaches, sand, tracks, fields and paddocks.
  • Water submersion — including crossing creeks, rivers, flooded areas, salt water, or driving on beaches.
  • Warning lights / overheating — damage occurring when the vehicle is driven despite a warning light being illuminated or the coolant gauge entering a red zone.
  • Improper accessory use — damage caused by incorrect fitting or use of snow chains, ski/snowboard racks, roof racks or bicycle racks.
  • Required snow chains — incidents where snow chains are required by law on the road or ski-resort access road and not fitted.
  • Reckless or wilful misconduct — all damage from reckless or wilful misconduct by you or your invitees, including sitting or standing on the vehicle's bonnet, boot or roof, or towing another vehicle.
  • Incorrect fuel or water — all costs related to the improper use of fuel or water in the vehicle.
  • Single-vehicle rollover or tip — any incident involving a single vehicle that has rolled, tipped or fallen over.
  • Commercial use — use of the vehicle for commercial purposes, such as a taxi or courier service.
  • Racing or contests — operation of the vehicle in any race, speed test, rally or contest.
  • Beyond agreement terms — any damage or costs incurred when the vehicle is operated outside the terms of the Rental Agreement.

13.3 Other exclusions

  • Lost or damaged keys — the cost to replace lost, broken or damaged keys, and the cost of retrieving keys locked inside the vehicle.
  • Interior & accessory damage — all costs from breakages, loss, theft or defacement of the vehicle's interior and accessories.
  • Theft from unlocked vehicle — theft of, or damage from theft of, the vehicle or its contents where the vehicle was left unlocked.
  • Contents not covered — your insurance covers the vehicle itself only; it does not cover the replacement or repair of contents supplied by us (e.g. cooker, bedding, cutlery, tables, chairs, tents, roof racks, power cords, keys) or any other items rented from us.

14 - Theft or Loss

If the vehicle is stolen or written off during your rental, you are covered under your selected insurance option (section 12) — provided the incident is not the result of a Substantial Breach (section 6).

If the loss does result from a Substantial Breach, you will be liable for the full value of the vehicle. Your bond will be applied first, with any balance charged to your nominated card.

In any case of theft, you must report it to NZ Police immediately and obtain a written police report before any insurance claim can be processed.

15 - Rental Duration & Late Return

  • Rental charges are calculated on a calendar-day basis. The day of pick-up is Day One, and the day of drop-off is the final day, regardless of times. The minimum hire period is 7 days.
  • A specific pick-up and drop-off time must be agreed in advance. Changes require our written approval and may affect availability.
  • If you wish to extend the rental, you must obtain our prior written approval. Extra days are charged at our standard daily rate at the time of extension.
  • If you return the vehicle after the Return Time without prior written consent, a late fee of $150 NZD applies, plus the daily rate for each 24-hour period (or part thereof) the vehicle is overdue.
  • If you return the vehicle to a different location than agreed, you may be charged the cost of returning the vehicle (towing or relocation), plus a relocation fee of up to $1,500 NZD.
  • After-hours pick-up or drop-off can be arranged with at least 3 days' notice for a fee of $100 NZD.
  • If the vehicle is not returned by the Return Time and we cannot reach you, we reserve the right to report the vehicle as stolen to NZ Police.

16 - Payment & Cancellations

A non-refundable deposit of 20% of the total booking cost is required to confirm your reservation. If the booking is made 30 days or less prior to pick-up, the full amount is payable at the time of booking.

Cancellation penalties (calculated against total booking value):

  • 28 days or more before rental start: 40% penalty.
  • 14 to 27 days before rental start: 60% penalty.
  • Less than 7 days before rental start: 100% penalty.

All amounts are payable in New Zealand Dollars by credit/debit card or bank transfer. Cash is not accepted. Bank transfers for the rental balance must be received at least 14 days before pick-up; the bond cannot be paid by bank transfer.

17 - GPS & Electronic Tracking

You acknowledge and agree that our vehicles may be fitted with GPS tracking and other telematics devices. We may use these devices to:

  • Recover the vehicle in the event of theft, loss, or breach of these terms.
  • Assist in the event of an accident, breakdown or emergency.
  • Verify location, speed, mileage and travel area for the purpose of enforcing this Agreement (including travel-restriction and off-road clauses).
  • Provide vehicle data to NZ Police or other authorities where required by law.

18 - Data Protection

Hazy collects, stores and uses personal information in accordance with the Privacy Act 2020 (NZ). We collect information you provide at booking (name, address, contact details, licence and payment details) and use it to deliver the rental, manage your account, process payments, recover the vehicle, comply with our legal obligations, and (with your consent) send you marketing about Hazy. We may share your information with NZ Police, enforcement authorities, our insurers, and our authorised service partners where reasonably necessary. You may request access to or correction of your information at any time by emailing hello@hazycampers.co.nz.

19 - Termination

We may refuse any rental, terminate this Agreement and/or repossess the vehicle at any time without notice if you breach these terms, commit a Substantial Breach (section 6), or in our reasonable judgement pose a risk to the safety of yourself, others, or the vehicle. On termination, you remain liable for all rental charges accrued and any damage, fines or third-party claims.

20 - General

  • Governing law. This Agreement is governed by the laws of New Zealand. The parties submit to the exclusive jurisdiction of the New Zealand courts.
  • Entire agreement. This document, together with the Rental Agreement signed at pick-up, contains the entire understanding between you and us, and supersedes any prior agreement.
  • Severability. If any provision is held to be invalid or unenforceable, the remaining provisions remain in full force.
  • No waiver. Our failure to enforce any provision does not constitute a waiver of our right to do so later.
  • Force majeure. Neither party is liable for any delay or failure to perform caused by events beyond reasonable control — including natural disasters, public-health events, civil unrest, government action, or major weather events.
  • Title. The vehicle remains the property of Fortescue Campers Limited at all times. You hold it as a bailee only and may not sell, transfer, encumber, or sub-let it.

By renting from Hazy Campers, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
